DHS condemned the ruling and referred to the immigrant, Jordin Alexander Melgar-Salmeron, as a “serial criminal illegal alien” in a post on X.
“This ruling is completely at odds with President Trump’s duty to faithfully execute federal law,” DHS posted.
The New York-based U.S. Court of Appeals for the 2nd Circuit issued the ruling on Tuesday, informing the administration it must take action to retrieve Melgar-Salmeron “as soon as possible” after officials violated an agreement with the court by deporting him a day earlier than the court would allow and roughly 30 minutes after the court granted him a stay of removal.
The removal is argued to be the result of “a confluence of administrative errors,” according to the court documents.
